MAK Comps – General Website Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the MAK Comps website and your participation in competitions organised by MAK Comps (the “Promoter”), a sole trader operating under a trading name in the United Kingdom.

By accessing the website, creating an account, entering a competition, or purchasing a ticket, you agree to be bound by these Terms.

Throughout these Terms, “we”, “us”, and “our” refer to MAK Comps as the Promoter.

2. Eligibility

2.1 Competitions are open to UK residents aged 18 or over.

2.2 Participants must ensure that all information entered during account creation and order checkout is accurate.

2.3 The Promoter may not enter or win their own competitions.

2.4 Proof of age and identity may be required before awarding a prize.

3. How to Enter

3.1 To enter a competition, participants must:

• Select the competition

• Answer the skill-based question correctly

• Select ticket numbers where applicable

• Complete the payment via an accepted method

• Agree to these Terms

3.2 Each valid paid entry will be assigned a unique ticket number.

3.3

Incorrect answers to skill questions will result in the entry being deemed invalid for the purposes of winning, even if payment has been successfully processed. No refund will be issued for entries submitted with an incorrect answer.

3.4 Participants are responsible for ensuring they enter the correct competition and select the desired numbers.

4. Free Postal Entry Route

In compliance with the Gambling Act 2005, each competition includes a free alternative method of entry.

4.1 Postal Entry Requirements

Each postal entry must be handwritten and include:

• Full name

• Full postal address

• Email address

• Contact phone number

• Name of the competition

• The chosen ticket number

• The correct answer to the competition’s skill question (written in full)

• The following declaration:

“I confirm I have read and agree to the MAK Comps Terms & Conditions.”

4.3 Postal Entry Conditions

4.3.1 One entry per envelope. Multiple entries in one envelope will be rejected.

4.3.2 No hand-delivered entries are permitted.

All entries must be sent via Royal Mail or recognised postal service.

4.3.3 The details provided in the postal entry must match exactly the details of the entrant’s website order or account details. Failure to match details will result in the entry being invalid.

4.3.4 Postal entries must be legible, complete, and undamaged. Entries that are torn, wet, smudged, incomplete, illegible, or otherwise unclear will be invalid.

4.3.5 Postal entrants must select an available ticket number.

If the chosen number has been purchased or reserved before the entry is processed, the postal entry is invalid. The entrant may submit another entry in a new envelope.

4.3.6 Postal entries must be received and processed by the Promoter at least 7 days before the scheduled closing date published when the competition opens.

Important:

The deadline is based on the scheduled closing date, not the actual closing date (competitions may close early or be extended).

The postal-entry deadline does not change if a competition is extended.

4.3.7 Processing definition:

A postal entry is not considered received upon delivery to the Premises.

It is considered received only when opened and processed by the Promoter.

The Promoter’s records regarding receipt and processing of postal entries shall be final.

4.3.8 Postal entries will be opened and processed within a reasonable timeframe during normal business hours.

The Promoter is not responsible for postal delays or processing delays.

4.3.9 The Promoter is under no obligation to hold or reserve ticket numbers for postal entrants.

4.3.10 Only one postal entry per person per calendar day is allowed.

5. Payments

5.1 Accepted payment methods include:

• Debit/credit card

• Apple Pay

• Google Pay

• PayPal

5.2 An entry is only valid when payment has been successfully processed.

5.3 All paid entries are non-refundable, except where a competition is cancelled by the Promoter.

5.4 By entering a competition, participants agree not to initiate chargebacks or payment disputes (including via PayPal) for valid entries submitted in accordance with these Terms. Any disputes raised contrary to these Terms will result in account suspension.

6. Competition Duration, Closing & Extensions

6.1 Each competition runs for a minimum of 8 days, unless sold out earlier.

6.2 Competitions may close early if all available tickets are sold.

6.3 The Promoter may extend a competition if the minimum level of paid entries has not been reached by the scheduled closing date. Extensions may be applied repeatedly and in any duration deemed necessary (e.g., 24-hour increments or longer).

6.4 Competitions may also be extended for operational or technical reasons.

6.5 The postal-entry deadline is based solely on the original scheduled closing date and does not extend if the competition closing date is extended.

6.6 Extensions to a competition do not entitle entrants to a refund. By entering, participants acknowledge that the scheduled closing date is provisional and may change in accordance with these Terms.

7. Draws & Winner Selection

7.1 Winners are chosen using a fair and random method such as a Random Number Generator (RNG) or other verifiable method.

7.2 All draws will be conducted live on Instagram at @mak_custom, unless otherwise stated.

7.3 Draws may be recorded or published for transparency.

7.4 If a winner cannot be contacted or cannot verify their identity within 7 days of the draw, an alternative winner may be selected.

8. Prizes

8.1 Prize descriptions and conditions are listed on each competition page.

8.2 Prize condition varies:

• Banshees – typically used but refurbished

• Bikes – typically brand new

• Other items – as described

8.3 Unless explicitly stated, prizes are provided as-is without warranty.

8.4 Cash alternatives will only be offered if stated on the competition page.

8.5 Cash Prizes

Where a cash prize is offered, payment will be made by UK bank transfer only.

Winners of cash prizes must provide valid UK bank account details, including:

•Account holder name

•Account number

•Sort code

Cash prizes will be paid within 7 working days of the winner providing correct and complete bank details.

The Promoter is not responsible for delays caused by:

•Incorrect or incomplete bank details

•Banking system delays outside the Promoter’s control

Cash prizes are non-transferable, cannot be exchanged, and no alternative payment method will be offered unless explicitly stated.

If a winner fails to provide valid bank details within 14 days of notification, the Promoter reserves the right to select an alternative winner.

 

9. Refunds & Cancellations

9.1 Paid entries are non-refundable unless:

• The Promoter cancels the competition

• A technical error prevents allocation of entries

9.2 If a competition is cancelled, all entrants will receive a full refund via the original payment method.

9.3 For the purposes of these Terms, a “Competition Cancellation” occurs only where the Promoter formally withdraws a competition and confirms that no draw will take place and no winner will be selected.

A competition is not considered cancelled where it is extended, delayed, closed early due to sell-out, amended in accordance with these Terms, or where the scheduled closing date changes.

10. Prize Collection

10.1 All prizes are collection only, unless otherwise stated.

10.2 Prizes are collected from:

10.3 Prizes must be collected from the Promoter within 7 days of the winner being notified, unless otherwise agreed in writing.

If the winner fails to collect the prize within this period, the Promoter may:

  1. Charge a storage fee of £20 per day, starting from the 8th day after notification; and/or

  2. Declare the prize forfeited if the prize has not been collected within 14 days of notification.

If the prize is forfeited, the Promoter may select an alternative winner or dispose of the prize at their discretion. No refund will be issued for forfeited prizes.

10.4 Winners must present valid ID matching their account details.

10.5 If a winner provides incorrect or incomplete contact details and cannot be reached via the email address or phone number supplied at checkout, MAK Comps will make reasonable attempts to contact them. If no response is received within 7 days, the winner may forfeit the prize, and an alternative winner may be selected in accordance with these Terms.

11. Website Availability & Liability

11.1 The Promoter is not responsible for:

• Internet connection issues

• Website downtime

• Payment gateway failures

• Postal delays

• Errors made by entrants

11.2 The Promoter is not liable for:

• Loss or damage after prize collection

• Misuse of the prize

• Costs relating to insurance, tax, or maintenance

• Any disappointment, loss of opportunity, or expectation of winning arising from participation in a competition

11.3 Entrants participate at their own risk.

12. Account Conduct

You agree not to:

• Create multiple accounts

• Use bots or automated systems

• Attempt to manipulate draws

• Abuse staff or other users

• Interfere with the website’s operation

Accounts violating these rules may be suspended or terminated.

13. Intellectual Property

All content, logos, designs, and images on the MAK Comps website belong to the Promoter and may not be reproduced without permission.

14. Privacy & Data Protection (GDPR)

14.1 We collect personal data to administer competitions and contact winners.

14.2 Data is stored securely and never sold.

14.3 Participants may request access, correction, or deletion of their data.

14.4 Our Privacy Policy and Cookie Policy explain how your data is used.

15. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be handled exclusively by the courts of England and Wales.

16. Changes to Terms

The Promoter may update these Terms at any time. Changes take effect upon publication on the website.
